The Ohio Green Party recommends a “No” vote on Issue One, Marcy's law. Although the Green Party strongly supports victim’s rights and respects the experiences of survivors of abuse and crime, the Green Party is concerned that this proposed constitutional amendment limits the disclosure of potentially exculpatory evidence to the accused, and therefore would significantly erode important Constitutional protections needed to ensure fair trials and protect the equally important rights of the innocent and the falsely accused. Experience has shown that limiting exculpatory evidence at trial can lead to deprivation of due process and can undermine the reliability of verdicts and sentencing decisions, especially in poor communities. The right to a fair trial is a fundamental guarantee under our constitutional system. Greens are concerned that the United States has one of the highest prison populations per capita, in the world. Greens are further concerned about the existence of a for-profit prison system in Ohio. The Green party would advocate for better community resources, mediation, restorative justice, and a system that respects the rights of survivors of abuse and crime without undermining the rights of the accused under the US and Ohio Constitution.
